You have the right to compensation if the airline cannot justify why you were denied boarding. Justified grounds include concerns over health, safety, or incomplete travel documents, but not because the flight was overbooked.
If you are denied boarding, you are also entitled to a replacement flight or, if you decide not to fly, to a refund of your ticket.

When an air carrier reasonably expects to deny boarding on a flight, if an insufficient number of volunteers come forward to allow the remaining passengers to board the flight, the air carrier may then deny boarding to passengers against their will, in which case it must compensate them.
If your flight is subject to EU legislation, being involuntarily ‘bumped’ entitles you to exactly the same rights as if the flight was cancelled, and you should be able to claim your compensation immediately. Air carriers give priority to persons with reduced mobility and any persons accompanying them.
When an air carrier reasonably expects to deny boarding on a flight, it first calls for volunteers to surrender their reservations in exchange for certain benefits. If an insufficient number of volunteers come forward to allow the remaining passengers to board the flight, the air carrier may then deny boarding to passengers against their will, in which case it must compensate them.
If you’ve suffered a lengthy flight delay, don’t be put off taking the airline to court to claim the compensation you’re rightly owed. Just ask one MoneySaver, who won a case against Thomson.
Jeremy Noott, a radio trainer and presenter from North Yorkshire, was recently awarded 1,600 (1,238) in compensation by a judge at York County Court after his family of four were delayed for nearly 21 hours on a Thomson flight. (See our Flight Delays guide for information on how to claim.)
The Flight Delay Compensation Regulation (EC) No 261/2004 is a regulation establishing common rules on compensation and assistance to passengers in the event of denied boarding, flight cancellations, or long delays of flights. It repealed Regulation (EEC) No 295/91, and went into effect on 17 February 2005. It sets out the entitlements of air passengers when a flight that they intend to travel on is delayed or cancelled, or when they are denied boarding to such a flight due to overbooking, or when the airline is unable to accommodate them in the class they had booked.
European Regulation 261/2004 is a law that protects airline passengers’ rights. It says that under certain conditions, passengers can claim compensation if their flight is delayed for over three hours.
The law says that airlines must pay compensation if they are at fault for the delay but are not obliged to pay if the delay is due to “extraordinary circumstances”.
